Constitutional Principles

The constitutional framework is grounded in principles intended to ensure democratic legitimacy, institutional stability, and long-term protection of fundamental rights. These principles serve as guiding standards for constitutional drafting, legal interpretation, and institutional design.


1. Popular Sovereignty

All political authority originates from the people. Governance institutions derive legitimacy solely from the consent of the governed and must remain accountable through democratic procedures, transparency, and legal responsibility.

2. Rule of Law

All individuals and institutions are subject to the law. Laws must be publicly accessible, stable, applied equally, and enforced by independent courts. Arbitrary governance is incompatible with constitutional order.

3. Separation of Powers

State authority shall be divided among legislative, executive, and judicial institutions with effective checks and balances. No branch may dominate or absorb the functions of another.

4. Protection of Fundamental Rights

Fundamental rights and freedoms are inherent and inviolable. Rights must be constitutionally guaranteed, legally enforceable, and protected against infringement.

5. Minority Protection and Non-Domination

Democratic governance must protect against domination and structural exclusion. Equality requires constitutional safeguards that prevent marginalization and discrimination.

6. Cultural and Linguistic Rights

Language, culture, and education are foundational components of democratic participation and collective identity. Cultural rights are institutional and enforceable.

7. Land, Commons, and Intergenerational Responsibility

Land and natural resources are shared foundations requiring sustainability, stewardship, and intergenerational responsibility. Resource governance must serve the long-term public interest.

8. Judicial Independence

An independent judiciary is essential. Courts must be impartial and protected from political interference. Constitutional review mechanisms ensure compliance with constitutional standards.

9. Democratic Participation

Citizens shall have the right to participate meaningfully in public affairs through free and fair elections, civic engagement, and access to information.

10. Accountability and Transparency

Public institutions must operate transparently and be accountable. Oversight and disclosure mechanisms prevent corruption and abuse of power.

11. Constitutional Stability and Adaptability

The constitution must balance stability with adaptability. Amendment procedures shall protect core principles while allowing democratic revision over time.
